KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Mr. Justice Yousuf Ali Sayeed ordered respondent officials of DIT, Pakistan Customs to act “strictly in accordance with law”.
The order came during hearing of a constitution petition filed by Dawn Impex which imported miscellaneous items from different sources around the world.
Ghulam ullah Sheikh advocate duly instructed by Faisal Ghani, CEO of Franklin Law Associates argued the petition.
He maintained that DIT has no powers or jurisdiction to act within the port area. The DIT can act, confiscate, detain any consignment when it is out of the port area. The action by the DIT officials within the port area is nothing but illegal, being beyond jurisdiction and infringement upon jurisdiction of other custom officials dealing with a consignment.
The bench allowing the urgency application while fixing Jan 12 as next date of hearing, ordered DIT officials to act strictly in accordance with the law and remain well within their jurisdiction.
