KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Muhammad Humayun Khan on Wednesday ordered release of a consignment of soap against payment of differential amount between declared value and Valuation Ruling. The bench earlier heard Ghulam ullah Sheikh advocate of Franklin Law Associates who contended that Director General of Pakistan Customs, Valuation while passing an Order in Revision enhanced the value of the item. The act of the DG was illegal, arbitrary and in excess of jurisdiction as under section 25 of the Customs Act 1969 he has no powers to enhance the value. The counsel sought same order as was passed by this bench in CP-D 4790 of 2016. The bench noting that the plea was identical as was raised in 50 other petitions now pending hearing before the court ordered Pakistan Customs to release the consignment if the petitioner pays differential amount between the declared value and Valuation Ruling. The bench asked the petitioner to submit the amount before the Nazir of the court who after satisfying that government dues are secured will ensure the release of the consignment.
