SHC allows provisional release of consignments of toilet soap
KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Muneeb Akhtar and Justice Muhammad Humayun Khan on Wednesday ordered provisional release of two consignments of toilet soaps.
The bench earlier heard Ghulam ullah Sheikh advocate of Franklin Law Associates appearing for the importers Ashraf traders and Shazak Multinational and others.
The counsel maintained that dispute pertains to the valuation as the valuation department increased the value arbitrarily and failed to appreciate the falling prices of toilet soaps in the international market.
The Customs Valuation has no powers to determine the valuation ruling and increase the value unilaterally without resorting to the procedure enumerated in the section 25 of the Customs Act 1969. He prayed to the court to direct the custom authorities to release the consignment provisionally.
The bench after hearing the sides ordered provisional release of the consignments of the petitioners if they secures the differential amount between the Valuation Ruling and the declared value.
