KARACHI: An appellate bench of Sindh High Court (SHC) comprising Justice Irfan Saadat Khan and Justice Muhammad Humayun Khan allowed time to respondents as well as customs in a Special Custom Reference Application (SCRA) filed by Director, Pakistan Custom’s Valuation.
The SCRA was filed against an order of the Special Customs Appellate Tribunal passed in an appeal filed by the Rak Trading Co. The tribunal sat aside a Valuation Ruling. The order was one sided and to benefit only one importer, the Customs Valuation maintained in the SCRA praying the court to declare the order of the tribunal as null and void.
The petitioner challenged the VR 758 of 2015 replacing VR 538/2013 on ground that while the value of tile from different origin has registered a decrease of 20-30 per cent in the valuation by Custom officials ignoring the facts and has enhanced the value of the tiles of different origin.
