KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Muhammad Humayun Khan on Friday ordered release of three consignments consisting Overhead Cranes.
The bench heard Sohail Muzaffar advocate, counsel for respondent custom officials who said that assessment was being made on the basis of 90 days data.
The bench referred to section 25 of the Customs Act 1969 and observed that it talks about identical goods. The counsel for customs submitted that it was a dispute over assessment on the basis of transactional value and value assessed by the authorities.
Aqeel Ahmed Khan advocate appearing for the petitioner Fareed Engineering Works said that there was a huge difference between the two values.
The bench later after detailed hearing ordered the petitioner to submit security in respect of difference between the transactional and assessed values to the satisfaction of the Nazir of the court who after verification was asked to issue a certificate for release of the goods in dispute.
