KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Muhammad Humayun Khan on Thursday ordered issuance of notices to respondent custom officials of Hyderabad Model Customs Collectorate for Nov 03.
The bench was hearing a petition filed by Muhammad Idrees through his counsel Zia-ul-Hassan advocate.
The counsel for petitioner told the bench that his client purchased mobiles from local market against proper receipts. The consignment was being transported from Rawalpindi to Hyderabad when the same were taken into custody at Jamshoro Toll Plaza and was confiscated after hearing the owners and issuance of show cause.
The owner/petitioner challenged the action of custom officials before the Special Customs Appellate Tribunal which allowed the appeal.
The custom officials of MCC Hyderabad despite order of the Tribunal refused to release the consignment against which the instant petition was filed.
The bench today after hearing Zia-ul-Hassan advocate ordered issuance of notices to the respondent officials for Nov 03 while they were also restrained from taking any action against the petitioner/owners of the goods.
