KARACHI: Allowing a request made by Principal Appraiser, Law, Pakistan Customs, Ilyas Ahsan for time to procure some material documents from Federal Board of Revenue (FBR), a division bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Syed Saeed-uddin Nasir on Friday fixed Nov 2 as next date of hearing.
The bench earlier heard Khursheed Javed advocate, counsel for Zenith Chemicals, Lahore who imported “Acetaminophen”, used as basic pharmaceutical ingredient.
Today at the outset of hearing, Principal Law officer of Pakistan Customs assisted by Kashif Nazeer advocate said that in fact some provisional assessment was made on the orders of the FBR and that they are trying to get the same for evaluating the status of the case.
The counsel for petitioner submitted that it is a five year old case and yet Customs failed in finalizing the assessment. He maintained that Customs at the back of the petitioner finalized the assessment, applied for release of surety and tried to en-cash the cheques deposited with them.
As there was no intimation to the petitioner, the cheques bounced at which custom officials with malafide intention themselves handled the case while lodging a FIR against the applicant.
The bench later fixing new date of hearing ordered the respondents to call whatever record pertaining to the petition or subject matter of the petition.
