KARACHI: Member Judicial Customs Appellate Tribunal Karachi, Muhammad Nadeem Qureshi has struck down the adjudication order as well as order-in-appeal against M/s silver Surgical complex Pvt Ltd and extended the benefit of SRO 1125(I)/2011 on the import of bulk needles from China.
According to the details of the case, M/s Silver Surgical Complex imported a consignment of bulk needles 23G and 24G from China at declared value of $29.03/kg and sought clearance claiming benefit of SRO 1125(I)/2011.
In this regard investigation was carried out and it was found that bulk needles are used in manufacturing of disposable syringes and IV canola, which have multiple usage and termed as medical appliances. Thus fall outside the purview of surgical goods. Hence the benefit of claimed SRO is denied.
The imported approached the Tribunal submitting that while making final assessment, Customs Appraisement made the wrong observation about the description and use of the goods.
After detailed deliberation of the case, the Tribunal set aside the impugned order and ordered release of the goods under benefit of the concessionary SRO.
