KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Abdul malik Gaddi on Thursday while issuing notice to the Commissioner Inland revenue Hyderabad division for Sept 23 suspended an order of attachment of account of Jamshoro Power Limited.
Adovcate Aqeel Ahmed Khan appearing for the applicant/petitioner company submitted that it is a government entity producing power for National Grid. The gas from the Sui Southern Gas Company Ltd (SSGCL) was being used for the electricity generation and SSGCL pays all the relevant taxes, duties and other levy.
The counsel maintained that the respondents served a notice which was challenged by the applicant before the Tribunal which allowed the same on ground that Additional Commissioner IR has exceeded his pecuniary jurisdiction. The department was asked by the tribunal to reconcile the demand raised as a result of which a reconciliation report was prepared. According to that report only rupees 15000 were demanded out of rupees 60 million demand raised, submitted the counsel adding that while it was proved that dispute arise because the NTN number was not mentioned in the reply by the applicant. The department suddenly attached the account of the applicant, the counsel stated giving reason for an urgent hearing and interim order.
The bench after perusing the documents and initial submissions made by the counsel for applicant suspended the attachment order. The bench also ordered issuance of notices to the respondents for Sept 23.
