KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtarand Justice Anwar Hussain on Wednesday allowed Customs to hold hearing in a show cause notice issued to Nishat Mills, Lahore but restrained them from passing any order or adjudicating the dispute without permission of the court.
The bench was hearing a petition filed by Nishat Mills who questioned the denial of exemption on import of LED lights and lamps under 5th schedule of Customs Act 1990.
The bench today was seized with the hearing of an application seeking an order of restraint. The court perused the reply of the show cause notice issued by the Pakistan Customs MCC, East and reply filed by the petitioner. The bench noted that the reply to the show cause notice was confined to petition before SHC which is already fixed for hearing on Oct 06.
The bench directed the petitioner to filed reply to the show cause on merit and to attend the proceedings before the forum concerned. According to show cause notice petitioner evaded rupees 2,240, 832 by abusing the exemption available under 5th schedule of the Custom Act 1969, 6th Schedule of Sales Tax Act 1990 and Second Schedule of Income Tax Ordinance 2001.
