KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Abdul Malik Gaddi on Wednesday dismissed two identical Special Custom Reference Applications (SCRA’s) filed by Additional Director, Directorate General of Intelligence and Investigations, FBR.

The bench earlier heard Khalil Dogar advocate, counsel for the I&I, Pakistan Customs at length who maintained that the appellate tribunal erred while deciding in favour of the owners/appellants of oil tankers Bashir Ahmed and Abdul Haq. According to applicant I & I, their staff intercepted the oil tankers on National Highway and arrested the drivers for carrying smuggled HSD.

The owners presented purchase voucher, invoice of PSO authorized dealer at Kandiaro and submitted that HSD was duly purchased and not a smuggled commodity.

The customs department assailed the judgment by the customs appellate tribunal which in 2011 which were decided today after five years of litigation. The bench in its detailed order dismissed the SCRAs.
