KARACHI: The Collector of Customs Appeals Dr. Zulfiqar Ahmad Malik has set aside the order-in-original served on M/s Leader A.G by assistant collector adjudication penalizing the company for mis-declaring the value of goods.
According to the details, M/s Leader AG imported consignment of Atrazine (50 percent) plus Mesotrione (5.0 percent) SC and sought clearance. The consignment was picked for scrutiny. Examination found an invoice pinned on the consignment mentioning values higher than the declared values.
Customs adjudication established the mis-declaration and penalized the importer M/s Leader AG. Dissatisfied, the imported approached Collector Appeals.
Collector Appeals examined the case records and noted the importer demonstrated with the help of documents that they contracted purchase of goods vide L/C at $3.35/kg. Later due to downward trend in prices, the goods were shipped without L/C at $2.20/kg against the same proforma invoice. The importer also placed on record, correspondence with supplier with reference to the found invoice. The supplier had tendered apology even prior to the issuance of show cause notice.
The importers emphasized that the goods are free of customs duty and chargeable to concessionary rate of sales tax. Moreover, identical goods are being assessed at $1.80/kg to $2.2/kg.
Collector Appeals set aside the order-in-original and also ordered to assess the goods on declared value.
