KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Zulkfiqar Ahmed Khan on Friday allowed three days’ time to Customs valuation to decide the controversy regarding Valuation Ruling 787/2016.

The counsel for petitioner filed the petition seeking release of amount with Nazir they submitted for release of their consignment.

Masooda Siraj advocate appearing for the Customs valuation said that petitioner was demanding concession of the new Valuation Ruling retrospectively. She said that rules do not permit the same.

The counsel said that they filed the GD and got their consignment released by paying customs duty and other levies. He submitted that they filed the GD at the rate of US $ 1.20  while Custom valued the same at 2.80 . The consignment was release on payment of duty and securing differential amount with the Nazir of the SHC. They maintained that later new Ruling was issued under which identical goods were cleared at a rate of US $ 1.4 . Seeking benefit of the new Valuation Ruling 787/ 2016 the petitioner prayed for return of differential amount.

The bench  on a request by the counsel for respondent custom officials allowed three days’ time to them to file comments.
