KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Zulfiqar Ahmed Khan on Friday adjourned hearing of a review application filed by Pakistan Customs in a disposed of petition pertaining to alleged import of Indian cloth in violation of Import Policy.
Earlier the same bench allowing a constitution petition filed by M/s Badar Computers allowed release of the Indian cloth against payment of custom duty, taxes, fine and penalty.
Ilyas Ahsan, Appraiser Law, Pakistan Customs appearing for the applicants/respondents Pakistan Customs prayed to the court to review its judgment passed a few days back allowing release of the confiscated goods. He submitted that the import of cloth from India is banned and thus liable to be confiscated. The consignment could not be release as if a precedent is set then entire local industry would collapse and the smugglers of banned items would be encouraged, the review application said.
The bench after hearing initial arguments by the sides fixed March 24 for detailed arguments and decision.
