KARACHI: As the Islamabad High Court has dismissed their petition, MCC Appraisement West has served a notice on M/s Kingcrete Builders to pay Rs8.85 million into the national exchequer.

On the directives of Collector Owais Agha Jawwad to expedite recovery of government’s legitimate revenue, Assistant Collector Arslan Majeed Rana has dispatched the notice to M/s Kingcrete Builders to make the payment failing which recovery proceedings in terms of Section 202 of the Customs Act 1969 would be initiated against them.

M/s Kingcrete Builders executed a contract with National Highway Authority (NHA) for the construction of rigid pavement on specific sections of Lahore-Islamabad Highway. The company imported 13 concrete transit mixers (CTM) from Japan and provisionally got released the same from the Customs department on payment of 5.0 percent Customs Duty subject to final decision of FBR. The remaining amount comes to Rs8.85 million.

Dissatisfied with the decision, the importer approached Islamabad High Court. The Court observed that vide SRO 1090(I)/2006, 2500 concrete transit mixers were allowed exemption from levy of customs duty in excess of 5.0 percent on first come first serve basis.

The Court observed that FBR had rightfully denied the exemption and dismissed the petition by M/s Kingcrete Builders.
