SHC defers hearing of petition for release of Satellite equipment

KARACHI: A divisional bench of High Court of Sindh comprising Justice Muhammad Ali Mazhar and Justice Zulfiqar Ahmad Khan on Friday adjourned hearing of a constitution petition filed by Super Net Limited seeking clarification from Pakistan Customs that whether consignment in question fell within “PTA Type A” or not.

Earlier the counsel for petitioner told the bench that in routine, they used to import the equipment through sea route and always there was a quick clearance. This time we have imported it via airline and now being asked to pay duty etc while the consignment classified as Satellite Communication devices including LNB and Router are exempted from duty, the counsel submitted.

The bench asked the counsel for petitioner to establish the exact definition of the goods in dispute and their classification by the PTA, which is in fact the regulatory body.

Kashif Nazeer advocate, counsel for the Customs department sought ten days time to seek the necessary details so that court is properly assisted on technicalities.

The bench however on request by the counsel for petitioner fixed Friday next for hearing.
