KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Anwar Hussain on Thursday disposed of two identical petitions filed by Fayyaz Can and Bismillah Industries ordered Pakistan Customs to shift the consignments to a public bonded facility within three days.

Earlier the counsel for petitioner prayed to the court that petitioner is burdened every day due to accumulation of demurrage and despite requests, respondents custom officials are not allowing in-bonding. He sought a direction to the respondents for shifting of the imported consignment.

At a proposal by Kashif Nazeer, Counsel for customs department, counsel for petitioner agreed for the sampling. The customs maintain that issue in dispute is about the nature of the imported item that whether these are primary or secondary steel (Cold Rolled sheets).

The bench later in its order while ordering shifting of the consignment to the bonded warehouse also ordered that shifting would be conditional to payment of differential amount with the Nazir of the High Court. The petitioner also sought direction to the FBR for constitution of a Committee on steel products.
