KARACHI: Allowing an application for urgent hearing seeking implementation of order passed by Customs Appellate Tribunal, Karachi, a division bench of High Court of Sindh (SHC) comprising Justice Muneeb Akhtar and Justice Mrs Ashraf Jahan on Friday fixed Oct 16 to decide the controversy regarding additional duty demand by Custom authorities.

Paramount Corporation filed the application through counsel Syed Mohsin Imam who maintained that company imported motorcycle parts in a 20 feet container having a C & F value of US $ 21570.70 and applicable duties came to the tune of rupees 1,620,759 . The Custom officials examined the consignment physically and assessed that importer shall pay an additional amount of rupees 369,704 which was paid by the importer. The consignment was released but R & D  team intercepted the consignment and  re-examined the same. They found that 900 unit of 70 CC engines in CKD and they assessed the C & F value to be US $ 72896.21. The R & D assessed that importer applicant defrauded the customs duty to the tune of rupees 5,102,504.

The importer filed the appeal before the tribunal which allowed the appeal but as the order was not implemented the importer moved SHC. The counsel for applicant stated that since a year consignment is lying at the port and order of the tribunal is not being implemented.

The bench after hearing the counsel for applicant fixed Oct 16 to hear and decided the issue of release of consignment.
