KARACHI: The Federal Board of Revenue (FBR) has granted unlimited power to the Directorate General of Intellectual Property Rights Enforcement – FBR, which includes making arrests as well as prohibiting and restricting importation and exportation of goods.

The officers of Directorate General also have the authority to detain, seize and confiscate goods imported in violation of relevant provisions of the Act.

According to SRO 639(I)/2015, Director General of Intellectual Property Rights Enforcement has the authority to invoke all the relevant provisions of Customs Act including Sections 15, 16, 17, 26, 26A, 26B, 32(1), 32A(1), 48, 62, 91, 92, 139, 157, 158, 159, 161, 162, 163, l64, 165, 166, 167, 168(1), (3) and (4), 169, 171, 172, 174, 175, 185-F, 186, 193, 194-A, 196, 197, and 199.

Director of Intellectual Property Rights Enforcement has the authority to invoke all the relevant provisions of Customs Act including Sections 15, 16, 17, 26, 26A, 26B, 32(1), 32A(1), 48, 62, 91, 92, 139, 155L, 155M, 155N, 155O, 155P, 155Q, 155R, 157, 158, 159, 161, 162, 163, 164, 165, 166, 167, 168(1), (3) and (4), 169, 171, 172, 174, 175, 179, 185-F, 186, 193, 194-A, 196, 197, 198, 199 and 201.

The Director has the authority to audit and examine the records and take possession of and retain documents and records.

Additional Director of Intellectual Property Rights Enforcement has been authorized to invoke Sections 15, 16, 17, 26, 26A, 26B, 32(1), 32A(1), 48, 62, 91, 92, 139, 155L, 155M, 155N, 155O, 155P, 155Q, 155R, 157, 158, 159, 160, 161, 162, 163, 164, 165, 166, 167, 168(1), (3) and (4), 169, 171, 172, 174, 175, 179, 186, l93, 194-A, 197, 198, 199 and 201.

Assistant and Deputy Director of Intellectual Property Rights Enforcement has the authority to invoke Sections 15, 16, 17, 26, 26A, 26B, 32(1), 32A(1), 48, 62, 91, 139, 142, 155L, 155M, 155N, 155O, 155Q, 155R, 157, 158, 159, 161, 162, 163, 164, 165, 166, 168(1), (3) and (4), 169, 171, 172, 174, 175, 179, 196, 193, 197, 199, 199, 201.

The officers have been authorized to detain packages containing certain publications imported into Pakistan.

SPS Principal Appraisers and Superintendents and other officers/officials may invoke provisions under Sections 15 16, 17 26, 26A 26B, 32(1), 32A(1), 48, 62, 91, 92, 139, 142, 155L, 155M, 155N, 155O, 155P, 155Q, 155R, 158, 159, 161, 162, 164, 165, 166, 168(1), (3) and (4), 169(1), (2), (3), 171, 172, 174, 175, 186, 198 and 199.
