KARACHI: The Customs Appellate Tribunal has charged one Shaikh Mohammad Arif, an importer of chemicals, for unlawfully obtaining the zero rating of sales tax and exemption from payment of income tax as well as federal excise duty by cheating the system of automated clearances operative under PaCCS.
According to the briefs, Shaikh Mohammad Arif imported one consignment of monosodium glutamate and cleared the goods by availing the undue benefit of exemption of sales tax under SRO 63 8(1) 2005 which was only admissible to dye intermediaries.
These goods availed the undue benefit of exemption of zero rating of sales tax and exemption of income tax. A total amount of Rs0.234 million was short paid by the imported as monosodium glutamate was not at all a dyeing intermediary rather a food flavor.
The Tribunal upheld the order of Customs Appeals that the appellate i.e. Shaikh Mohammad Arif had no case on merit seeking waiver of the requirement of deposit of the adjudged amount of duty and taxes of Rs0.215 million and penalty on importer of Rs25,000.
