KARACHI: An appellate bench of High Court of Sindh on Tuesday disposed of a constitution petition filed by importer of sprinkler lorries case while observing that controversy would be decided in the Special Customs Reference Application (SCRA) filed by the Pakistan Customs.
According to the petitioner, he imported sprinkler lorry which was declared to be older than permitted age. While a constitution petition was pending, the department issued a show cause to which a reply was filed.
The matter went to the Special Customs Appellate Tribunal (SCAT) which allowed the appeal and ordered release of the vehicle used in construction works.
The matter reached Supreme Court which remanded back the case to SHC.
Today a SHC bench comprising Justice Aqeel Ahmed Abbasi and Justice Yousuf Ali Saeed after hearing the sides in the four year old case disposed of the petition and ordered that controversy would be decided in the SCRA filed by the department.
