SHC orders release of artificial leather

KARACHI: A customs appellate bench of High Court of Sindh on Friday ordered release of a consignment of artificial leather.

The consignment was detained by the Pakistan Customs as the department officials disputed the PCT Heading as claimed by the importer/petitioner Xama Private Limited. The petitioner sought exemption from Sales Tax under SRO 1125 of 2011 while referring to Chapter 39 of the Import rules. The customs treated the consuignment under Chapter 39 declaring the imported item as “texture fabric”.

The bench today after hearing the counsel from Franklin Law Associates representing the importer/petitioner ordered release on payment of differential amount besides security with Nazir of SHC.

The same bench also ordered release of a consignment imported by Nishat Textile Mills which was detained on the issue of Regulatory Duty already decided by SHC bench a month back.

The bench said the consignment, subject matter of this petition be released as per judgment in petition CP-D 7159 of 2017.
