SCAT reserves order in Valuation case

KARACHI: A special customs appellate tribunal (SCAT) comprising Nadeem Qureshi, member Judicial and Nazim Saleem, Member Technical on Wednesday reserved order in an appeal pertaining to valuation dispute.

Minitech corporation filed the appeal through Franklin Law Associates assailing the order passed by the Director General Valuation.

According to details, the petitioner company imported Fiber Optical Cable and the Director Valuation, Pakistan Customs assessed the value at US $ 3.65 per kilogram.

The assessement was challenged in a revision and the DG Valuation maintained the order of the Director Valuation against which the instant appeal was filed.

The counsel for petitioner arguing the appeal before the tribunal submitted that the evidence/data available was about US $ 2 per kilogram but Director Valuation arbitrarily and in violation of section 25 (a) made the so-called inquiry which was not shared with the stake holders. It was also maintained that the impugned order in revision militaes against judgments in Good Will Traders and Sadaia Jabbarcase.

The customs appellate tribunal after hearing the sides reserved the judgment on Wednesday.
