KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Mrs Ashraf Jahan fixed feb 12 to decide controversy over nature of construction vehicle.
The bench earlier heard Ms Dil Khurram Shaheen advocate who informed the bench that off late, the department has vacated show cause notice. She contended that petitioner has not violated the import policy order.
The bench at this stage referred to a case law commonly known as Burki judgment and said the imported construction vehicle shall not be more than 5 years old.
The counsel for department in defense maintained that the vehicle shall accompany Pre Shipment Inspection Certificate.
The bench after hearing the sides fixed Feb 12 for a decisive hearing.
