KARACHI: An appellate bench of High Court of Sindh  (SHC) comprising Justice Munib Akhtar and Justice Zulfiqar Ahmed Khan on Wednesday ordered forth with release of over a dozen consignment of Solar/DC LED lights.

The bench was hearing a constitution petition filed by Millad Traders and 13 Ors, importers of LED lights. Secretary FBR, Collector Customs, Port Muhammad Bin Qasim, Engineering Development Board, Alternate Energy Development Board are cited as respondents.

Hyder Shaikh advocate of Franklin Law Associates appearing for the petitioners submitted that they availed the exemption under 5th Schedule of Customs Act 1969, 6th Schedule of Sales Tax Act 1990 (Entry 15) but the respondent Customs Collectorate is not releasing the consignments which have already landed at the port while others are arriving.

The bench after hearing arguments by Customs side said earlier order passed in CP-D 5049/2017 (Aleem Enterprises) is applicable in these petitions too. The bench ordered forthwith release of the consignments of the petitioners. The bench previously held that petitioner are entitled to the exemption claimed by them.

There are about a hundred more containers stuffed with the same item waiting clearance at Karachi Port.
