Karachi A division bench of High Court of Sindh comprising Justice Munib Akhtar and Justice Anwer Hussain hearing two identical petitions about alleged tempered vehicles ordered Pakistan customs to either obtained interim relief in special custom reference applications or release the vehicles in one week time.
Ghulam Ali and Adnan filed petitions for release of Toyota Hiace vans confiscated by customs for being smuggled vehicles. Earlier the council for Pakistan customs inform the bench that the department has filed reference applications against the order of special customs appellate tribunal relied upon by the petitioners.
Dil Khurram Shaheen Advocate appearing for petitioners submitted that vehicles were not released despite clear orders by the appellate tribunal. She also maintained that no interim order was obtained by the department in SCRA.
The bench also heard Kashif Nazeer Advocate representing Pakistan customs and asked the respondent department to either obtain interim order or explain on next date of hearing of why clear orders of the tribunal were not implemented.
