KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Jusitce Munib Akhtar and Justice Abdul malik Gaddi on Thursday issued notices to the  Federal Secretary Revenue Division,  Chairman FBR, Commissioner Inland Revenue, Large Tax Payers Unit II, Karachi and Chief Collector Customs in a petition filed by Shafiq Sons.

The petitioner maintained that the respondents are collecting  Sales tax, Income Tax  at a rate of 17 and 3 per cent respectively at import stage being a commercial importer/proprietor of a firm while concession is allowed to industrial units importing the same items.

Terming the same as discriminatory and onerous burden, the petitioner prays to the court to declare that no tax could be levied except under or by  authority of an Act of the parliament and not by  way of subordinate legislation, rules framed under a Statute or through an executive order.  The petitioner also prays for refund of two sums of rupees 79,7766 each.

 The bench however after hearing initial arguments ordered issuance of notices to the respondents for April 12.
