KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Wednesday disposing of a constitution petitioner ordered release of the consignment of baby diapers on payment of differential amount with Nazir of SHC.

Earlier, the bench heard Ghulamullah Advocate who prayed for conditional release of the consignment.

Masooda Siraj, Kashif Nazeer advocates for Customs valuation department and Ilyas Ahsan law officer for Model Customs Collectorate opposed the plea on ground of maintainability of the petition. They said that petitioner United World Corporation has filed an appeal before the Special Customs Appellate Tribunal and thus has exhausted remedy available to them under the law. In this situation, seeking a remedy through the petition is against the provisions of law, they submitted.

The counsel for petitioner submitted that he filed the petition as the other appellate forums including departmental authority declined the release of the consignment. The petitioner is facing demurrage and other levies, he said praying for provisional release.

The bench later allowed the petition directing the petitioner to submit pay order of differential amount with the Nazir of the court.
