KARACHI: The Ali Sian Dino Metlo Labour Appellate Tribunal Sindh dismissed the seven identical applications of Customs House Common Pool Trust Model Customs Collectorate (Appraisement) Karachi to exercise its suo moto revisional jurisdiction and set aside orders of Sindh Labour Court V Karachi dismissing its seven appeals under section 17 of the Payment of Wages Act 1936.
The Court dismissed the applications on the ground that the applicant failed to deposit the directed amount as required by the proviso to section 17(I) (a) ibid.
The respondents under section 15 of the Payment of Wages Act 1936 demanded for their legal dues and the Authority under its order June 25, 2014 directed the applicant to pay the legal dues with penalty within one month.
The applicant appealed before the Labour Court without depositing the directed amount. The Labour Court dismissed the appeals as time barred and non-maintainable due to failure of the applicant to deposit the directed amount.
