KARACHI: A divisional bench of High Court of Sindh comprising Chief Justice Sajjad Ali Shah and Justice Anwar Hussain on Friday adjourned hearing of a constitutional petition filed by Fast Cables until Jan 26.

Earlier counsel for the petitioner sought provisional release of the consignments maintaining that they have filed the review application for reassessment order. He said that a notice for hearing of the same was also received by the petitioner, which has been duly replied, and a copy has been submitted with the court. There is no fine or penalty imposed hence consignment can be released after payment of fine and penalty through post dated cheques. Ilyas Ahsan, law office for Pakistan Customs told the court that the department has prepared a contravention report and matter will be proceeded further. He told the bench that controversy pertains to the payment of three per cent additional Sales Tax. The counsel maintained that if raw material is imported for industrial purpose, it is exempted from duty but if it is sold directly then 3 per cent duty is recoverable. The department has questions about imported consignment he said adding that a contravention report has been prepared and show cause would be served upon the petitioner. The bench later after hearing the counsel for parties adjourned proceedings until Tuesday next directing the customs to complete the formalities by the next date of hearing.
