KARACHI: Collector Custom, Model Custom Collectorate, Port Muhammad Bin Qasim filed a Special Customs Reference Application (SCRA) here Tuesday, against a decision by Special Customs Appellate Tribunal, Bench III.

The SCRA questions the remission of redemption fine and penalty imposed against the petitioner/respondent Imroze Steel.

According to detail Imroze Steel imported a consignment of Hot Cold Rolled Steel/grained steel sheets and filed a GD under PCT code 7225.1900. The said PCT heading attracts zero per cent custom duty while Sales Tax at the rate of 17 per cent, Additional Sales tax at the rate of 3 per cent and Income Tax at the rate of 5.5 per cent was levied.

The customs conducted a physical examination and found the goods to be Cold Rolled Coils which falls under PCT heading 7209.1710. The said PCT attracts 20 per cent custom duty. The MCC made a case of mis-declaration and filed the case before the Adjudicating authority which imposed a redemption fine of 35 per cent besides imposing a penalty of rupees 200000.

The appellant/respondent then filed the appeal before the special tribunal and Member Technical III Khalid Mehmood allowing the appeal ordered remission of the redemption fine as well as penalty of rupees 200,000 imposed holding the order by the adjudicating officer as “un-necessary and harsh” against which the instant SCRA was filed by customs through Masooda Siraj advocate.
