KARACHI:- A division bench of High Court of Sindh (SHC) comprising Chief Justice Faisal Arab and Justice Iqbal Kalhoro on Thursday disposed of a constitution petition filed by Thatta Power (Generation Company) against demand raised by Income Tax department.

The bench asked the petitioner company to move the Income Tax Appellate Tribunal while directing the Tribunal to decide the appeal by the petitioner company “expeditiously”.

The bench earlier heard Advocate Aijaz Hussain Shirazi, counsel for the petitioner who maintained that companies power generation plant was gas fired and hence exempted from taxes etc under the government policies announced time to time with a view to encourage power generation in private sector in view of acute shortage of electricity generation and supply.

He termed the demand raised by Income Tax department as illegal.

 The bench after hearing the counsel for IT department disposed of the petition directing the petitioner to approach the Income Tax Appellate Tirbunal first. The bench also directed the tribunal to decide the appeal by the petitioner “expeditiopusly”.
